Lagunitas Mariners Tickets Sweepstakes OFFICIAL RULES THERE IS NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE OF ALCOHOLIC BEVERAGE IS NOT REQUIRED TO PARTICIPATE NOR WILL IT INCREASE YOUR CHANCES OF WINNING. SWEEPSTAKES OPEN ONLY TO LEGAL RESIDENTS OF OR, WA, MT, HI, AK, AND ID WHO ARE AT LEAST 21 YEARS OF AGE OR OLDER AT TIME OF ENTRY. VOID WHERE PROIHIBITED. ELIGIBILITY: The Lagunitas Mariners Ticket Sweepstakes (the 'Promotion') is open only to legal residents of Oregon, Washington, Montana, Hawaii, Alaska and Idaho who are 21 years of age or older at the time of entry ('Entrant'). Void where prohibited or restricted by law. Employees of The Lagunitas Brewing Company ('Sponsor'), its advertising and promotional agencies involved in the promotion, including BLOC MKTG (the "Administrator"), state alcohol beverage commissions, alcoholic beverage manufacturers, distributors, and retailers, and their respective parent companies, subsidiaries, and affiliates, and their immediate family members (spouse, parent, sibling, and children) or members of the same household of any of the foregoing are not eligible to participate. All applicable federal, state, and local laws and regulations apply. AGREEMENT TO OFFICIAL RULES: Participation in this Promotion constitutes your full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions. These decisions are final and binding in all matters related to this Promotion. Receipt of a prize is contingent upon fulfilling all applicable requirements set forth herein. TIMING: The Promotion begins on June 1, 2022 at 12:00:00 AM Pacific Time ('PT') and ends August 27, 2022 at 11:59:59 PM PT ('Promotion Period'). For purposes of this Sweepstakes, a 'day' is defined as a 24-hour period, beginning at 12:00:00 AM PT and ending at 11:59:59 AM. The Administrator’s computer, or that of its designee, runs the official clock for the Sweepstakes and will solely determine the time by which an entry is received. HOW TO ENTER: (1) During the Promotion Period Entrants can go to LagunitasMarinersSweeps.com or use your smart phone or other web-enabled device with data plan to scan the Sweepstakes quick response ('QR') code and you will be sent to the website to enter; (2) Complete the registration form providing your contact information which may include your first and last name, address, phone number, zip code and email address; and (3) Click the submit button. QR Code Users: To scan a QR code, Entrants must have a smart phone or other web-enabled device with a camera feature or QR scanner and may incur message or data charges from their wireless service provider for each message sent and received. If you do not have a QR reader already installed on your phone, type ‘QR reader’ in your mobile device’s application store search field to find available QR readers for your smart phone or other web-enabled device. You will receive a response which will contain a link to download a QR reader for your specific device. Standard data rates may apply. Check with your wireless service provider for details on these and any other applicable charges. Entrants are solely responsible for any such wireless charges. Not all cellular phone providers carry necessary service to participate. Check your phone capabilities for specific scanning instructions. Data service is not available in all areas. An entrant can enter the Promotion only once during the Promotion Period. Multiple entries by the same person will not be counted. Sponsor is not responsible for lost, late, damaged, incomplete, invalid, un-intelligible, garbled, delayed or misdirected entries, all of which will be void. In the event of a dispute over the identity of any potential winner, the entry will be declared made by the authorized account holder of the account used for entry, and potential winner may be required to provide identification sufficient to show that he/she is the authorized account holder. PRIZES & DISTRIBUTION: There are Three (3) Grand Prizes. Each (3) Grand Prize Winner will receive: Four (4) Tickets to one of the Seattle Mariners’ home games detailed below (each, a 'Game'): Friday, July 22nd at 7:10 p.m. PT against HOU ('Game 1') Friday, August 26th at 7:10 p.m. PT against CLE ('Game 2') Friday, September 30th at 6:40 p.m. PT against OAK ('Game 3') • (Approximate Retail Value ('ARV'): $260); • One (1) $250 Visa® gift card for spending money, including for travel to and from the Game (ARV: $250); • One (1) $200 gift card to the Lagunitas Schwag Shop (ARV: $200); and • A VIP experience at the Lagunitas Beer Sanctuary in Seattle, WA (ARV: $50) Total ARV of each Grand Prize: $760.00. Total ARV of all prizes: $2,500.00. The odds of winning a prize depend on the total number of eligible entries received in each market as defined above by the end of the Promotion Period. PRIZES ARE AWARDED 'AS IS' WITH NO WARRANTY OR GUARANTEE, EITHER EXPRESS OR IMPLIED. Prize may not be substituted, assigned or transferred or redeemed for cash, except Sponsor reserves the right to substitute a prize of equal or greater value. Winner is responsible for all applicable federal, state and local taxes, if any, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided. Winner must be 21+. Alcoholic beverages are not part of the prize. Travel to and from the Game is not included in the prize and is the full responsibility of Winner. All prize details are at Sponsor’s sole discretion. Only the advertised number of prizes and those claimed in accordance with these Official Rules will be awarded. Gift Cards stated herein and shall include and herein be referenced as 'Promotional Card' collectively to any prefunded bank card, a gift card, an electronic gift card, stored-value card or certificate, a store card, merchant card, voucher for services or goods, a gift certificate or similar instrument and other redeemable instruments with value credit or the like that may be awarded are subject to terms, conditions and restrictions as set by issuer. *Promotional Cards are subject to the terms of use, applicable conditions and restrictions, including any expiration dates, promulgated by issuer of card. The Promotional Cards are not transferable, redeemable for cash or exchangeable for any other prize. Redemption of the Promotional Card will be subject to the standard terms, conditions and restrictions applicable to the participating merchant and or the card issuer in effect on the day of issuance of the promotional card. The promotional card cannot be redeemed for the purchase of other promotional cards. Except as required by law, the Promotional Card cannot be reloaded, resold, transferred for value, redeemed for cash, or applied to any other account. The Sponsor is not responsible if any Promotional Card is lost, stolen, destroyed or used without permission. If the promotional card is lost or stolen, it will not be replaced. No substitutions allowed except by Sponsor at its sole discretion for a prize of comparable value. PRIZE DRAWINGS: On or about July 1, 2022, August 1, 2022 and September 1, 2022, one (1) Grand Prize Winner will be randomly selected from among all eligible Entries received, for a total of three (3) Grand Prize Winners selected in three (3) separate random drawings for the Promotion Period. Drawings will be conducted by the Administrator, an independent judging organization whose decisions are final and binding on all matters related to the Sweepstakes. The odds of winning a Grand Prize depend on the total number of Entries received. Entries that are not drawn as a potential winner in each drawing are eligible to win subsequent drawings. For purposes of clarity, an Entry on or before June 30, 2022 that is not selected as a potential winner on July 1, 2022 will be automatically entered for a chance to win the next drawing, on August, 1, 2022, and so on. WINNER NOTIFICATION: The potential Grand Prize Winners will be notified by email and/or phone on or about July 2, 2022 for Game 1, August 2, 2022 for Game 2, and September 2, 2022 for Game 3. The potential Grand Prize Winners will be required to complete, sign, and return an Affidavit of Eligibility and Liability Release and, where legal, a Publicity Release (collectively the 'Affidavit') and an IRS Form W-9. The potential Grand Prize Winners will be required to furnish his/her social security number that will be used only for the purpose of reporting the Winner’s prize earnings to the Internal Revenue Service, as required by law. Completed documents must be returned within five (5) calendar days from prize notification date or the prize will be forfeited and awarded to an alternate potential winner. If a potential Grand Prize Winner (i) cannot be contacted after a reasonable attempt has been made by Sponsor or Administrator (as determined in Sponsor’s sole discretion); (ii) fails to timely return the required paperwork without alteration and in the form presented by Sponsor/Administrator; (iii) refuses the prize; and/or (iv) the prize or prize notification is rejected or returned as undeliverable, then such potential Grand Prize Winner forfeits all rights to be deemed a winner in the Sweepstakes and receive the prize, and will be disqualified and an alternate potential Grand Prize Winner will be determined based on the next entry selected at random. Prize must be accepted as awarded. PUBLICITY: Acceptance of any prize shall constitute and signify each winner’s agreement and consent that Sponsor and its designees may use the winner’s name, likeness, photo, entry submission, and/or prize information in connection with the Promotion for promotional, advertising or other purposes, worldwide, in any and all media now known or hereafter devised, including the Internet, without limitation and without further payment, notification, permission or other consideration, except where prohibited by law. Sponsor and its designees shall have the right to edit, exploit, adapt, distribute, post, and create derivative works of, in whole or in part, and in combination with other materials, in any manner, for any advertising, promotional, trade, commercial or other purposes in any and all media, now or hereafter devised, worldwide, in perpetuity, and without further payment or consideration, notification or permission. RELEASE: By participating in the Promotion and/or accepting a prize, the Entrant agrees to release and hold harmless Sponsor, Administrator and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers/partners, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the 'Released Parties') from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Promotion or receipt or use or misuse of a prize. Entrant hereby agrees to indemnify and hold Sponsor harmless from and against any third-party claims, actions or proceedings of any kind and from any, and all damages, liabilities, costs and expenses, including attorney fees and court costs, arising out of any breach or alleged breach of any of the warranties and representations set forth herein. Entrant further understands and agrees that all rights under Section 1542 of the Civil Code of California ('Section 1542') and any similar law of any state or territory of the United States that may be applicable with respect to the foregoing release are hereby expressly and forever waived. Entrant acknowledges that Section 1542 provides that: 'A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.' GENERAL CONDITIONS: By participating, Entrants agree to be bound by these Official Rules and the decisions of Sponsor. If, for any reason, the Promotion is not capable of running as planned, Sponsor reserves the right, in its sole and absolute discretion (a) to cancel, terminate, modify or suspend the Promotion, including not selecting a winner; and/or (b) proceed with the Promotion, including selecting a winner in a manner it deems fair and reasonable, including from among eligible, non-suspect entries received prior to such cancellation, termination, modification or suspension. Sponsor will not be responsible for any prize cancellations, delays, diversions or substitutions or any other causes beyond its reasonable control, including by any event organizer or any other persons providing any goods or services related to the prize. No refund or compensation will be made in the event of the cancellation, delay, or substitution of any prize beyond the reasonable control of Sponsor, except in the sole discretion of Sponsor. Sponsor, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the Entry process or the operation of the Promotion or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner and void all associated Entries. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek any and all remedies available from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. LIMITATIONS OF LIABILITY: Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by Entrant, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the Entry process or the Promotion; (4) printing, typographical, technical, computer, network or human error which may occur in the administration of the Promotion, the uploading, the processing or judging of Entries, the announcement of the prizes or in any Promotion-related materials; (5) late, lost, undeliverable, damaged entries; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Promotion or receipt or use or misuse of any prize (including any travel/activity related thereto). Released Parties are not responsible for misdirected or undeliverable entries or for any technical problems, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Released Parties are not responsible for any unauthorized third party use of any Entry submission. GOVERNING LAW: This Sweepstakes is subject to all applicable federal, state, and local laws. This Sweepstakes and Official Rules are governed and interpreted by the laws of the State of California, USA without regard to its conflict of law provisions. The Released Parties will not sell, share or otherwise disclose information collected in any manner with third parties, other than those parties necessary to fulfill the above purposes, unless Entrant has given his prior express consent to receive additional information from the Released Parties or a third party.
